"Lost Highway Saturn SKY" Sweepstakes
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
ELIGIBILITY: The "Lost Highway Saturn SKY Sweepstakes" ("Sweepstakes") is open to legal residents of the continental U.S., excluding New York and Florida, who are at least 18 years of age or older (19 in Alabama), possess a valid drivers license as of the start of the Sweepstakes, are not in prison, and have not been arrested or convicted of a drunk driving or driving under the influence offense. Employees, directors and officers of AEG Live, Saturn Corp., General Motors Corp. (collectively the "Releasees") and their respective parent companies, affiliated companies, subsidiaries and any of their agents, advertising, promotional and other agencies, and the immediate families (parents, siblings, children and spouse) and persons living in the same household (whether related or not) of such employees/directors/officers are not eligible to enter the Sweepstakes or win a prize. Void where prohibited. This Sweepstakes is sponsored by AEG Live, 5750 Wilshire Boulevard, Suite 501, Los Angeles, CA 90036 ("Sponsor"). Sweepstakes begins at 8:00am (Eastern Time) on November 7, 2007 and ends 11:59pm (Eastern Time) on April 30, 2008 (the "Sweepstakes Period").
TO ENTER: There are two ways to enter. These official rules are available online at http://bonjovi.aeglive.com/saturn. To enter online: Access the official entry website anytime during the Sweepstakes Period and check out what's cookin' with Bon Jovi, and Saturn. Then, follow the online instructions to enter the Sweepstakes. To enter by mail: Put your name, address, email address, and phone number on a 3X5 index card, place the card in an envelope, and mail it LOST HIGHWAY SATURN SKY Sweepstakes 5750 Wilshire Boulevard, Suite 501, Los Angeles, CA 90036. Online entries must be received during the Sweepstakes Period according to Sponsor's server. Mail-in entries must be postmarked no later than April 30, 2008 and received by May 7, 2008. Incomplete, lost, misdirected, postage-due, corrupted, garbled, or otherwise illegible entries are void and will not be accepted. Envelopes containing multiple entries will be disqualified. Entries become the property of Sponsor, and are subject to Sponsor's privacy policy, located at http://www.aeglive.com/privacy.php, and will not be acknowledged or returned. Entries limited to one (1) per natural person during the Sweepstakes period. In the event that there is a dispute over the owner of an email account, Sponsor will determine the winner as the person who is listed by the email provider as having authorized use of the account.
DRAWING: One Grand Prize winner ("Selected Entrant") will be selected in a random drawing to be held on or about May 12, 2008 from among all eligible entries received. Odds of winning depend on the total number of eligible entries received. Many will enter; only one will win. Selected Entrant will be notified by phone or email using the information provided on the original entry form. By entering, entrant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters. Non-compliance with the requirements set forth in these Official Rules may result in disqualification and selection of an alternate Selected Entrant.
PRIZES/ODDS OF WINNING: One (1) Grand Prize: One (1) 2008 Saturn SKY. Silver Graphite color, black leather interior, 5 speed automatic transmission. Preimium tire package, and 18" chrome-plated aluminum wheels, am/fm radio and CD/MP3 Monsoon premium audio system (the "Prize Vehicle"). Approximate Retail Value for each Grand Prize ("ARV"): $27,000.00, each. Actual value may vary based on amenities Selected Entrant not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. Selected Entrant is solely responsible for any and all federal, state, and local taxes on prize, including special airport taxes and fees. The depiction of the Prize Vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner. Upgrades or special orders are at Selected Entrant's expense. Options listed may change without notice. Retail value is approximate and Selected Entrant is entitled only to Grand Prize as described above, regardless of ultimate prize value. Selected Contestant cannot assign or transfer his or her prize to another person. No prize substitution is allowed except at the discretion of Sponsor. If prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded. The Prize Vehicle shall only be delivered in the continental United States and winner shall take delivery of the Prize Vehicle at the Saturn dealership or Retail facility designated by the Sponsor in the continental U.S. reasonably close in proximity to the Selected Entrant's residence. Prizes will be awarded, subject to the limitations stated in these official rules. Grand Prize is not transferable or redeemable for cash under any circumstances. If, for any reason, Grand Prize cannot be awarded, Sponsor reserves the right, in its sole discretion, to award a prize of equal or greater value.
The winner shall be responsible for all taxes, license, title and registration fees or other costs, including without limitation any travel or transportation costs, associated with transferring and/or winning of the Prize Vehicle (provided, however, the Prize Vehicle shall be delivered at no additional delivery costs to the winner at an authorized Saturn dealer or distributor in the continental U.S. reasonably close in proximity to the Selected Entrant's residence);
Sponsor shall not be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. Sponsor, however, shall use all reasonable efforts, subject to availability, to deliver the Prize Vehicle within 6 ñ 8 weeks after receipt of all prize verification declarations and affidavits required. The winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the specified delivery site. In addition to the eligibility requirements to enter, Selected Entrant may be asked, and must agree to, a criminal background check at the department of motor vehicles and/or with law enforcement. Selected Entrant must personally retrieve the vehicle within 30 days of notification of delivery and must present adequate personal identification and evidence of legally required insurance prior to being awarded the Prize Vehicle(or an alternative Selected Entrant shall be selected and the original Selected Entrant's rights to the Prize Vehicle shall be automatically forfeited). The Prize Vehicle will be delivered solely with the express written limited warranties set forth in the vehicle's applicable Owner's Guide, which warranties shall run for the term set forth in that Guide. Selected Entrant will be issued an IRS form 1099. The Grand Prize is a taxable event.
CONDITIONS OF PRIZE. In addition to the foregoing, the Grand Prize Selected Entrant will be required to provide a declaration or affidavit of eligibility and liability/publicity release, which may require notarization, at Sponsor's discretion. Failure to provide this or any requested documentation shall result in forfeiture of the prize.
ADDITIONAL TERMS: Entrants shall release, and Sponsor shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of the prize, or from participation in the Sweepstakes; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes.
Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Sweepstakes. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Sweepstakes in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives.
By entering the Sweepstakes, entrants agree to be bound by these Official Rules and agree: (1) the Sweepstakes Entities, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, and advertising/sweepstakes agencies may use their name, voice, city/state of residence, photograph, visual and/or audio likeness for advertising and/or trade purposes and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and (2) to release and hold harmless the Releasees and their respective advertising and sweepstakes agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever, including, without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in this Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity, printing, distribution or production errors, and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Saturn shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner's Guide for the Prize Vehicle.
By participating in this Sweepstakes, entrants agree to be fully and unconditionally bound by these Official Rules and the decisions of the Sponsor, any and all other Releasees, and Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules.
Sponsor or its affiliates may rescind any promotion found to contain such errors without liability at its sole discretion. NEITHER SPONSOR NOR THE SWEEPSTAKES ENTITIES MAKE ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (UNLESS SPONSOR PROVIDES THE PRIZE WINNER WITH WRITTEN WARRANTIES). FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS OR ACTS OF ANY GOVERNMENT OR AUTHORITY
Sponsor shall not be liable to any winner or any person claiming through such winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor's sole control
LAW: Sweepstakes is subject to all applicable federal and state laws and regulations. The Sweepstakes is governed by the laws of California and by entering you consent to jurisdiction in the federal and state courts of San Francisco County, California for the resolution of any and all disputes.
PRIVACY: This Sweepstakes is administered in accordance with Sponsor's privacy policy, which may be found at http://www.aeglive.com/privacy.php. By participating in the Sweepstakes you authorize AEG and Saturn to communicate with you by e-mail, postal mail, facsimile, standard cellular telephone line and/or text messaging, consistent with the privacy policy.
WINNER LIST: For the names of the winners or a copy of these official rules, please send a self addressed, stamped envelope to: Lost Highway Saturn SKY Sweepstakes Winners List Requests, 5750 Wilshire Boulevard, Suite 501, Los Angeles, CA 90036, for receipt by 12/31/08. Winners' lists will be sent once winner has been verified and prizes have been awarded.
